  • Buying the land and then having other people improve it is a security, whether that's just appreciation of the land value or a dividend for the use of the land. As soon as the parcel owners receive appreciation or income from the efforts of others (including other parcel owners), it becomes a security.

  • I do think that the "Investment DAO" (which is a security, and regulated similarly to angel investing in a company) and the "Community DAO" (which advises the Investment DAO but has no expectation of profits) is the approach that gives you the most flexibility in potential uses down the road. It is more complicated upfront, but offers much more flexibility later on. Avoiding being a security upfront or fractionalizing the land creates significant restrictions later on.
